
David represents corporate fiduciaries and individuals in complex trust and estate litigation.
Before joining our firm in
2009, David litigated and tried significant trust and estate cases,
as well as complex securities, fraud and commercial cases for 16 years
at two of Chicago's leading large firms. Since 2004, David has concentrated
his practice in fiduciary litigation and associated commercial disputes,
and has represented prominent individuals in disputed matters concerning
family trusts, represented a national insurer of law firms defending
claims that its insureds breached fiduciary duties as trustees of a
$2 billion family trust, defended one of the nation's leading institutional
fiduciaries against a class action alleging fraudulent assessment of
fees and another against claims seeking to recover more than $100 million
for alleged malfeasance in the administration of a substantial family
trust.
Before concentrating entirely on fiduciary controversies, David represented
some of the nation's largest institutional investors and mutual fund
companies in complex securities fraud cases, and several Fortune 500
companies in substantial business disputes. David has tried several
cases in the United States district and bankruptcy courts, and in Illinois
Probate and other courts. His wealth of experience in complex business
and financial fraud disputes is integral to David's representation of
fiduciaries and beneficiaries in a broad array of disputes. David has,
for example, litigated several cases involving disputes among shareholders
and partners in family business or other closely-held businesses, often
when ownership is held by an estate or trust. He has also represented
individuals and businesses in civil litigation arising from alleged
tax shelter promotion or participation.
